Home Office Accepts Law Commission Proposals

The Law Commission welcomes the publication of the Serious Crime Bill and in particular part 2, which seeks to reform liability for encouraging or assisting crime.

Part 2 is based on the Law Commission report “Inchoate Liability for Assisting and Encouraging Crime”, published in July 2006. Professor Jeremy Horder, Criminal Law Commissioner at the Law Commission said In this report, we highlighted a significant gap in the current law. As the law stands, a person who intentionally or knowingly assists another person to commit an offence is not criminally liable if the offence is not subsequently committed or attempted.

We are very pleased to note that our recommendations have been taken up by the Home Office.

The Serious Crime Bill was introduced to the House of Lords on 16 January 2007 and is published today.
