Environmental Protection Act 1990 (Amendment) Bill

A Bill to amend Part II of the Environmental Protection Act 1990 in relation to the duties, powers and functions of waste regulation authorities concerning the unauthorised deposit of controlled waste on land; and for connected purposes.

Bernard Jenkin (Con, North Essex) introduced a ten minute rule Bill to combat fly-tipping on private land on March 11 2008.

He reported that the 1990 Bill had serious shortcomings and reported that his Bill has the support of the Country Landowners Association and the National Farmers Union.

He explained that fly-tipping on private land is often not dealt with, not reported, and can even result in the charging of the land owner for storing waste on their land.

The two measures in his Bill would “place an obligation on the Environment Agency or the relevant local authority to remove waste if the landowner “did not knowingly cause or knowingly permit” the waste to be deposited and “place a duty on the relevant authority to investigate incidents of fly-tipping.”
