Three senior judges have accused the home secretary of detaining a man for 16 months without charge or trial on the basis of "wholly unreliable" evidence.

The Special Immigration Appeals Commission yesterday ordered that the man, known as "M", be released, but the Home Office continued his detention pending an appeal.
