The government's plans to give train operators a place on the board of the company replacing Railtrack could breach EU law, according to European Commission officials. The officials are concerned that the inclusion of train operators could jeopordise compliance with an EU directive to ensure that operators' accounts and operations are legally separate from those of the company responsible for the network.
